Who we are and what these terms cover#
These Terms of Service ("Terms") are an agreement between you and Orbitally, based in Dhaka, Bangladesh ("we", "us", "our"). RapidAPI processes subscriptions purchased through its marketplace, but these Terms govern your use of our Service.
These Terms cover the Company Enrichment API (the "API"), the interactive playground and the product pages at https://orbitally.tech/products/company-enrichment-api (together, the "Service").
By creating an API key, subscribing to a plan, calling the API or using the playground, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility and business use#
The Service is sold for business use only. It is not offered to consumers.
You confirm that you are at least 18 years old, that you have the authority to bind the business you represent, and that you will use the Service for business purposes.
You may not use the Service if the law prohibits you from doing so, including under trade sanctions.
Plans, fees and billing#
The plans, prices and limits in force today are:
Scroll horizontally to view the full plan table.
| Plan | Price | Single-domain lookups / month | Overage / lookup | Multi-domain calls | Rate limit |
|---|---|---|---|---|---|
| Basic | Free | 30 (hard limit) | — | — | 5 requests per minute |
| Pro | $9.99 / month | 1000 | $0.03 per lookup | — | 15 requests per minute |
| Ultra | $34.99 / month | 3000 | $0.02 per lookup | 150; $0.15 per call | 30 requests per minute |
| Mega | $89.99 / month | 10000 | $0.01 per lookup | 500; $0.08 per call | 60 requests per minute |
The Basic plan has no charge and a hard monthly limit. Requests stop when you reach it. On paid plans, lookups beyond the included amount are charged at the per-lookup rate shown for your plan, where the table shows one.
Plans are sold and billed by RapidAPI through the RapidAPI marketplace. RapidAPI's own terms and policies apply to your subscription, payment, taxes and refunds, in addition to these Terms. If these Terms and RapidAPI's terms conflict on a payment matter, RapidAPI's terms apply to that matter.
Paid plans renew according to the plan you select on RapidAPI. You can unsubscribe through RapidAPI. RapidAPI's cancellation guidance (https://support.rapidapi.com/hc/en-us/articles/19348786555412-What-happens-if-I-cancel-my-API-subscription-before-the-billing-period-ends) says cancellation takes effect immediately and access to the API stops then; unused quota is not carried over if you subscribe again. RapidAPI's marketplace terms (https://rapidapi.com/page/terms) govern subscription payments and refunds. See our Refund Policy for Orbitally's policy.
We may change prices or plan limits by giving you at least 30 days' notice. A change applies from your next renewal. If you do not accept it, cancel before that renewal.
Applicable taxes are added where required.
If a payment fails or is reversed, we may suspend your access until the amount is paid.
Your account and API key#
Keep your API key confidential. You are responsible for everything done with your key. Do not put it in public code repositories or in code that runs in a visitor's browser.
Tell us promptly if you think your key has been exposed. We may revoke a key at any time if we think it has been compromised or misused.
Limits and fair use#
Each plan has a rate limit and a monthly allowance, shown in the plan table. Do not get around them, for example by creating several accounts or keys to avoid a limit.
The playground on our website is for evaluating the Service. Do not automate it, and do not try to get around its bot protection or limits. We may slow down or block traffic that looks automated or abusive.
Acceptable use#
You must not use the Service to:
- break the law, commit fraud, or send spam or unsolicited bulk messages that do not comply with the law that applies to you and your recipients;
- infringe anyone's intellectual property or privacy rights, including publishing personal data without a lawful basis, doxxing, harassing or stalking anyone;
- interfere with the security or operation of the Service, including by introducing malware, probing or scanning our systems, load-testing without our written permission, bypassing rate limits or bot protection, or scraping our website or playground;
- resell, sublicense or redistribute raw API access, or redistribute results in bulk, or use results to build a competing company-data product or dataset;
- profile or target private individuals, or make decisions about individuals that have legal or similarly significant effects, such as decisions about employment, credit, insurance or housing, based only on the results.
Your responsibilities for the data you receive#
Results can include names and business contact details, such as business email addresses and phone numbers, that companies have published on their own websites.
You are responsible for using any personal data in results lawfully. That includes having a lawful basis, honouring opt-outs, and following the marketing, telecoms and data-protection laws that apply to you and to the people you contact, such as the GDPR and ePrivacy rules in Europe and the UK, and the CAN-SPAM Act and similar rules elsewhere.
If we tell you that a person has asked for their data to be removed from our results, you will take reasonable steps to remove it from your own systems where the law requires.
Your input and our logs#
When you send a domain to the Service, you confirm that you have the right to do so. We process what you send, and technical data about the request, to provide the Service, keep it secure and enforce these Terms. Our Privacy Policy explains this in detail.
Results: ownership and licence#
We own the Service, including the API, the website, the software and our data models, and all related intellectual property. You keep ownership of what you send us. We do not claim ownership of the facts about companies that appear in results, and the owners of the underlying websites keep their rights in their own content.
Subject to these Terms and payment of any fees, we give you a non-exclusive, non-transferable, revocable licence to use results for your own business purposes. This includes storing results in your CRM or database and showing them in features of your own product. It does not include the restrictions listed under Acceptable use.
If you send us feedback or suggestions, we may use them without obligation to you.
Accuracy and no advice#
Results are produced from information published on company websites and from automated analysis. They can be incomplete, out of date or wrong. The confidence score is an indication, not a guarantee.
The API does not return revenue, exact employee counts or funding data. It returns a size band instead.
Results are general business information. They are not legal, financial, investment, tax or other professional advice. Check anything important before you rely on it.
Availability and changes#
We do not promise that the Service will be uninterrupted or error-free. We may carry out maintenance, and the Service may be unavailable from time to time.
We may improve, change or stop parts of the Service. Where a change is material and we can reasonably do so, we will give you advance notice.
Suspension and termination#
We may suspend or end your access if you materially breach these Terms, do not pay, create a security or fraud risk, repeatedly or seriously break the rules in these Terms, or if the law requires it.
You can stop using the Service at any time and cancel your plan as described above.
When your access ends, your API key stops working. Sections that by their nature should continue to apply, such as ownership, disclaimers, liability and governing law, continue to apply. Refunds are covered by the Refund Policy.
Disclaimers#
To the extent the law allows, the Service is provided "as is" and "as available", and we do not give any warranties, express or implied, including about quality, accuracy, fitness for a particular purpose or non-infringement.
Limitation of liability#
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, goodwill or data.
To the extent the law allows, our total liability for all claims relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim arose, or 100 US dollars if you have paid nothing.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud.
Indemnity#
You will defend us against, and reimburse us for, claims, losses and costs that arise from your breach of these Terms or from your use of results in breach of the law, for example your messages to people whose details you obtained from results.
Governing law and disputes#
These Terms and any dispute about them are governed by the laws of Bangladesh. The courts of Dhaka have exclusive jurisdiction, except where mandatory law gives you the right to bring a claim somewhere else.
Before starting formal proceedings, please contact us so we can try to resolve the issue informally.
Changes to these Terms#
We may update these Terms. The "Last updated" date at the top shows the current version. For material changes, we will give at least 30 days' notice by email to the address linked to your account where we have one, or by a notice on this page. If you keep using the Service after a change takes effect, you accept the new Terms.
General#
These Terms, with the Privacy Policy and Refund Policy, are the whole agreement between you and us about the Service. If a part of them is found to be unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms without our written consent; we may transfer ours. No one else has rights under these Terms. Neither of us is responsible for delays caused by events beyond our reasonable control. These Terms are written in English, and the English version prevails.
